SUBJECT: THE DRUG FREE SCHOOLS AND COMMUNITIES ACT COMPLIANCE
The Drug Free Schools and Communities Act (DFSCA) of 1989 requires institutions of higher education receiving federal funding to certify to the Secretary of Education they have developed and implemented a drug and alcohol abuse education and prevention program (DAAPP) to prevent the unlawful possession, use, sale, or distribution of illegal drugs and alcohol by all employees and students as part of any of its activities or on school properties.
It is the policy of 51³Ô¹ÏÍøÊÓƵ Baptist University to maintain an academic and work environment free from the unlawful use of illicit drugs and alcohol abuse. To that end, it is 51³Ô¹ÏÍøÊÓƵ's policy to comply in all respects with the DFSCA.
The 51³Ô¹ÏÍøÊÓƵ community, including all employees and all students enrolled in any courses for which academic credit may be earned, will receive written notification regarding the DAAPP. Information to be shared will include the following items:
- Standards of conduct that clearly prohibit, at a minimum, the unlawful possession, use, ordistribution of illicit drugs and alcohol by students and employees
- A list of applicable legal sanctions under federal, state, or local laws for the unlawfulpossession or distribution of illicit drugs and alcohol
- A description of the health risks associated with the abuse of alcohol or use of illicitdrugs
- A list of drug and alcohol programs (counseling, treatment, rehabilitation, and reentry)that are available to students and employees
- A clear statement that 51³Ô¹ÏÍøÊÓƵ will impose disciplinary sanctions for violations of thesestandards of conduct and a description of those sanctions, up to and including expulsionor termination of employment and referral for prosecution
Annual notification
As a requirement of the Drug Free Schools and Communities Act (DFSCA) regulations (EDGAR Part 86), 51³Ô¹ÏÍøÊÓƵ Baptist University will disseminate policy/information to all students each term and employees on an annual basis. This process is formally conducted by disseminating information regarding the DAAPP via an email to employees at the beginning of each fall semester, and to students at the beginning of each term for which they are registered. The Executive Director of Student Services in conjunction with the Clery Act and Drug Free Schools and Communities Act Compliance Committee will ensure the contents of the document fulfil the requirement set for by the DFSCA. The annual notification will be distributed from the office of the Executive Director of Student Services to students and from the Director of Human Resources to employees.
Biennial review
An additional DFSCA requirement is the completion of a biennial review of alcohol and other drugs (AOD) programs and policies to determine program effectiveness and consistency of policy enforcement and to identify and implement any changes needed to either. Each review covers the previous two academic years and will be done prior to the beginning of the fall term in even years. This review will be conducted by the Executive Director of Student Services in conjunction with the Clery Act and Drug Free Schools and Communities Act Compliance Committee.
